Legislation Updates

Federal:

  • A "Beach Bill" is probable with sponsorship from New Jersey. The bill is intended to deal with the quality of coastal waters.
  • There have been funding requests from the leadership of the House to President Clinton to increase Clean Water Act programs and from the Senate leadership to increase the State Revolving Fund three fold.
  • 2000 303 (d) list will probably be delayed.

State Legislation

  • No additional updates at this time although there are a number of growth bills for consideration in this session

Water Quality Control Commission Update (Paul Frohardt)

  • Comments on TMDL rules are finalized and on the WQCC website (handout available or refer to the website).
  • WQCC has discussed the timing for resolving EPA basic standards disapprovals in view of the Alaska case. WQCC currently plans to work disapprovals into the triennial review process (Handout on policy available on request)
  • Web address change— www.cdphe.state.co.us/op/wqcc/wqcchom.asp
  • WQCC is developing a stakeholder database—they need: name, organization, address, phone, fax, e-mail (WQCC will include WQF data base)
  • There will be a scheduled rulemaking hearing in March on Amendment 14 regarding repeal of the contract feeders deferral provision since the Legislative Legal Services Committee determined that the Commission does not have authority for this provision.
  • WQCC has 3 Commission terms ending; 2 commissioners are re-applying [Update: Only Robert Sakata is reapplying].
There will be no regular meetings for WQCC in April and June--the annual retreat will be held in June; July has reserved a 3rd day for Basic Standards (if needed). The August will be meeting in Montrose for the Colorado River Basin hearing. November 7, 8 and 9B South Platte rule making hearing. October 10th and 11th are new dates due to holiday.

Year 2000 303 (d) List Update (Sarah Johnson)

  • TMDL Public meeting—January 25, 1:00 PM in the Sabin Room at the CDPHE. (Check Web page below for more information)
  • TMDL web page now available on WQCD webpage—www.cdphe.state.co.us/wq/wqhom.asp

Basic Standards Update (Sarah Johnson)

  • There is now a revised draft of recommendations regarding Basic Standards rule making issues (handout available upon request).
  • Subcommittee meeting dates, times and locations are available on the WQCC website.
  • Basic Standards workgroup will be on January 18, 1:30 PM in the Carson room at CDPHE. Mixing Zones is on January 19, 2000.
  • The new EPA ammonia standards are available on the EPA website: www.epa.gov/ost/standards/ammonia.

Groundwater Policy Issues (Paul Frohardt--Handout available upon request)

  • Concern: There is not much factual information and/or case studies. How can we get real information to determine trends? Can we?
  • WQCC Public comment opportunity will be on February 14, 2000.

Storm Water (Kathy Dolan--handout available upon request)

  • Storm water workgroup/task force meeting February 23, 9:30 in the Sabin room at the CDPHE.
  • The task force will help develop a proposed regulation by August for a December WQCC rulemaking.
  • Ideas/programs from Denver, Aurora, Lakewood, Colorado Springs and League of Women Voters should be utilized.

WQF Website Update (Jeanne Work--handout available upon request)

  • New website address: www.cwqf.org
  • If you wish to be included in the Water Quality Forum Membership list on the website, Fax Jeanne Work of Carollo Engineers (303/635-1373) your name, organization, address, phone number and e-mail address. If you specifically do not wish certain information (e.g. your phone number) to be included on the website, please forward your request to Jeanne.
  • Next steps: a regular mailing will be done for the next mailing to the WQF. In the next months, we will post a notice of the meeting on E-mail and post the group memory and relevant documents on the website.
