USGS Update on New Database (Doug Cain)

Legislative Update (All)

  • A Federal bill regarding Beach monitoring just passed
  • There is an attempt underway to prohibit the EPA from further regulating point sources
  • Federal budget for water qualityC $120 million increase for Section 106 has been proposed by the House. The Senate proposed a $27 million increase and the Administration proposal was a $40 million increase. Logic indicates that while there will probably be a budget increase, it might be lower than expected given the Senate's proposal. The "matching money" requirement is still not certain as is the question of what exactly will the money be for.
  • WQCD is considering a bill on a permit fee structure for concentrated animal feeding operations

WQCC Update (Paul Forhardt)

  • Keli Powledge was recently hired by the OCB and the WQCC; Among other duties, she will maintain the web page.
  • The commission met on the Cherry Creek Reservoir which resulted in the adoption of a revised nutrient standard for the reservoir and continuing the Control Regulation portion of the hearing to May, 2001."
  • October 10-11 hearing:
    • Basic standards mixing zone
    • Triennial review on basic standards of groundwater
    • Annual SB 181 briefings
    • Annual hearing on intended user: non point source, revolving fund, construction
    • 401 Certification rulemaking hearing (e.g., how BMPs are identified for projects)
    • Information hearing on continuing planning process document
    • Public comment
  • November hearing
    • South Platte hearing (see "special topics" section on the WQCC web site)
    • Self audit bill re: MOU between state and EPA and public input process on implementation Hearing scheduled for 12:30 p.m. on November 21, 2000
  • Commission has drafted a status report and evaluation re: Implemented HB 92-1200 report recommendations (Handout available on request)

WQCD Annual Report to WQCC & Jt. Ag. Committee (Dave Holm)

  • Re: Status on permit back log—Final report is being drafted and will be presented in October. The report will be available on the WQCC web site after October 11, 2000.

Section 305 (b) Report from State to EPA (Sarah Johnson)

  • EPA indicated it may have withheld section 106 money unless the 305(b) report was received by October 1, 2000. They did receive the report from WQCD by October 1, 2000. On December 12, the report will be presented before the WQCC and will be available on the WQCC Web site by mid December.

Continuing Planning Process Document (CPP) (Paul Frohardt and Tad Foster—A handout is available upon request)

  • Schedule review expiration date is December 31, 2000
  • Commission will take input on any revisions to document in the October hearing and perspectives on approaches the state should take given new federal guidelines (e.g., preparing next 303 (d) list, etc.)
  • Give new and changing TMDL rules, what needs to be in the CPP document? What do we need as new regulations and what is written for strictly guidance?
  • Need to address when stakeholders will get notified regarding TMDL processes in CPP
  • Need to have descriptions re: Non-supportive, supportive and also non-attainment
  • Need to address compliance schedules (Can EPA authorize them? Should they?) Does Colorado's compliance language cover TMDLs?
  • Implementation plans- legal arguments will be made that EPA does not have the legal authority to include implementation plans within TMDL and that states ought to approve implementation plans
  • Options: Put CPP document on the shelf until later, reuse document, utilize it as a starting point for other methods/processes to the related issues (e.g., 303 (d) list/process, etc.)
  • WQCC needs feed back that is concrete

Storm Water Phase II Rule Making (Kathy Dolan)

  • Hearing on recommendations will be at WQCC December meetings
  • Party status must be established by October 3, 2000 for this hearing
  • Storm water Phase II recommendations will be available on the WQCC web site by October 15th
  • Basic standards working group meetings
